MOCHA FEST TERMS & CONDITIONS

Operated by Mocha Trips LLC

By making a reservation, purchasing a ticket, or participating in a Mocha Fest or Mocha Trips experience, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

DEFINITIONS

Hotel Packages: Any booking that includes hotel accommodations as part of a Mocha Fest event package, excluding Mocha Trips.

Tickets: Party Passes, Weekend Passes, Day Passes, individual event tickets, and other admission-only products that do not include accommodations.

Mocha Trips: Curated group travel experiences operated by Mocha Trips LLC that may include accommodations, activities, excursions, transportation, events, or other services as specified in the applicable trip itinerary.

Booking: Any reservation or purchase made directly through Mocha Trips LLC or an authorized Mocha Fest booking platform.

CANCELLATION POLICY

Hotel Packages

Cancellation penalties are determined based on the date the written cancellation request is received:

• 180 days or more before travel: $100 USD cancellation fee per person.
• 120-179 days before travel: $250 USD cancellation fee per person.
• 119 days or less before travel: 100% cancellation penalty. No refund will be issued.

All cancellation requests must be submitted in writing to reservations@mochafest.com.

Cancellation requests are not considered received until acknowledged by Mocha Trips LLC.

Mocha Trips & Tickets

All purchases of Mocha Trips, Weekend Passes, Day Passes, individual event tickets, and other admission-only products are non-refundable from the time of purchase, unless otherwise expressly stated in writing by Mocha Trips LLC.

REFUNDS

Where a refund is permitted under the applicable cancellation policy, the refund will be calculated after any applicable cancellation fees, non-refundable charges, and amounts already committed or paid to third-party suppliers.

Approved refunds are generally processed within 30 business days following approval, although processing times may vary depending on the circumstances of the reservation and payment method.

Unless otherwise agreed in writing, refunds will be issued to the original payee or through another payment method designated by Mocha Trips LLC.

Refunds are not available for products designated as non-refundable, including Mocha Trips and Tickets.

PAYMENT PLANS & AUTOMATIC PAYMENTS

Certain bookings may offer installment payment plans.

By selecting a payment plan and completing your booking, you authorize Mocha Trips LLC and its payment processor to securely maintain your selected payment method and automatically charge scheduled installment payments according to the payment schedule presented during checkout and/or shown on your booking confirmation.

The initial deposit is charged at the time of booking unless otherwise stated.

Remaining installments will be automatically charged to the payment method on file on the scheduled payment dates.

You are responsible for ensuring that a valid payment method with sufficient funds remains available.

If an automatic payment is declined or otherwise unsuccessful, Mocha Trips LLC may notify you and provide an opportunity to update your payment method or complete the outstanding payment. Failed payments may be retried.

Payments that remain outstanding for more than 10 business days after their scheduled due date may result in cancellation of the reservation without refund, subject to the applicable cancellation policy.

Requests to modify a payment schedule must be submitted at least 7 days before the applicable payment date and are subject to approval.

Mocha Trips LLC may, where appropriate, disable automatic payments for an individual reservation. Disabling automatic payment does not cancel or otherwise modify the customer’s outstanding balance, payment schedule, or obligation to make payments when due.

Customers may contact reservations@mochafest.com regarding their payment schedule or payment method.

By accepting these Terms & Conditions at checkout, you acknowledge and authorize the recurring charges associated with the payment schedule selected for your booking.

PRICING, FEES & BALANCES

Customers are responsible for reviewing the total price, deposit, fees, payment schedule, and remaining balance displayed before completing a booking.

Applicable booking, processing, platform, service, or other disclosed fees may be added to the advertised package or ticket price.

Any approved modification to a reservation may result in a change to the total booking price or remaining balance.

A reservation is not considered paid in full until all required amounts associated with the booking have been successfully received.

MOCHA FEST FUTURE CREDIT

Future credit may be offered at the discretion of Mocha Trips LLC after considering applicable cancellation penalties, supplier commitments, and other costs associated with the original reservation.

Unless otherwise stated in writing, approved future credits are valid for one year from the original cancellation date.

Once a credit has been applied to a new reservation, it cannot be reused.

Credits and payments are not transferable between guests unless expressly approved in writing by Mocha Trips LLC.

Requests regarding transfers must be submitted to reservations@mochafest.com.

Future credit has no cash value and cannot be redeemed for cash unless otherwise required by applicable law.

RESERVATION MODIFICATIONS

Requests to modify a reservation, including guest names, travel dates, hotel selection, room category, occupancy, or number of nights, are subject to availability and any restrictions imposed by third-party suppliers.

Changes may result in additional charges.

Name changes may be restricted or unavailable within 60 days of check-in depending on hotel or supplier requirements.

A requested modification is not confirmed until approved by Mocha Trips LLC.

EARLY CHECKOUTS, LATE ARRIVALS & NO-SHOWS

No refunds or credits will be issued for unused accommodations, missed events, early checkouts, late arrivals, or no-shows except where otherwise required by applicable law.

Changes to arrival or departure dates should be requested in advance and remain subject to availability, supplier rules, and the applicable cancellation policy.

TRAVEL INSURANCE

Customers are strongly encouraged to purchase comprehensive travel insurance appropriate for their trip.

Coverage may include trip cancellation or interruption, medical emergencies, emergency transportation, lost or delayed luggage, travel delays, and other unforeseen circumstances.

Customers are responsible for reviewing the terms, exclusions, and coverage limits of any insurance policy they purchase.

Mocha Trips LLC is not an insurer and does not determine whether a particular loss or circumstance is covered by a customer’s travel insurance policy.

PASSPORTS, VISAS & TRAVEL DOCUMENTS

Customers are solely responsible for obtaining and maintaining all passports, visas, entry authorizations, vaccinations, permits, or other documents required to enter or transit through their destination.

Passport and visa requirements vary based on citizenship, residency, destination, and transit countries.

Customers should verify applicable requirements with the relevant government authorities before travel.

Failure to obtain the required travel documentation does not entitle the customer to a refund and remains subject to the applicable cancellation policy.

ROOM ALLOCATION & SPECIAL REQUESTS

Hotel room assignments are controlled by the applicable hotel or resort.

Mocha Trips LLC cannot guarantee specific bed types, room numbers, floors, views, building locations, adjoining rooms, or other special requests unless expressly confirmed in writing.

We will make reasonable efforts to communicate special requests to the applicable property, but fulfillment remains subject to hotel availability and discretion.

HOTEL CHECK-IN & CHECK-OUT

Hotel check-in and check-out times vary by property.

Unless otherwise stated by the applicable hotel, guests should generally expect check-in during the afternoon and check-out during the late morning.

Early check-in and late check-out are subject to hotel availability and may result in additional charges.

HOTEL MAINTENANCE, CONSTRUCTION & RENOVATIONS

Hotels and resorts may conduct maintenance, renovations, construction, or other property improvements before or during a guest’s stay.

Where Mocha Trips LLC receives advance notice of significant work that may materially affect a guest’s stay, reasonable efforts will be made to communicate that information.

Mocha Trips LLC does not control hotel construction or maintenance schedules.

THIRD-PARTY SUPPLIERS

Mocha Trips LLC works with independent third-party suppliers, including hotels, resorts, transportation providers, tour operators, venues, entertainers, excursion providers, and other service providers.

Certain services included in a booking may therefore be subject to the terms, rules, schedules, restrictions, and operating conditions of those suppliers.

Mocha Trips LLC is not responsible for acts or omissions of independent third-party suppliers except to the extent required by applicable law.

ITINERARY & EVENT CHANGES

Event schedules, venues, performers, activities, excursions, transportation arrangements, and other itinerary components may be modified when reasonably necessary due to operational requirements, availability, safety concerns, weather, supplier changes, or circumstances outside the control of Mocha Trips LLC.

Where a material change occurs, Mocha Trips LLC will make reasonable efforts to provide an appropriate alternative where practical.

A change to an individual performer, venue, activity, schedule, or itinerary component does not automatically entitle a customer to a refund.

GUEST CONDUCT

Guests are expected to behave responsibly and comply with applicable laws, venue rules, hotel policies, safety requirements, and reasonable instructions from event personnel.

Mocha Trips LLC reserves the right to deny entry to or remove a guest from an event or travel experience when reasonably necessary due to threatening, abusive, disruptive, illegal, dangerous, or seriously inappropriate behavior.

A guest removed for such conduct may not be entitled to a refund for unused services.

Guests are responsible for damage they cause to hotels, venues, vehicles, equipment, or other property.

ASSUMPTION OF RISK & LIABILITY

Travel and participation in events, excursions, nightlife activities, water activities, transportation, and other recreational experiences involve inherent risks.

By participating, guests acknowledge and voluntarily accept the ordinary risks associated with the activities they choose to participate in.

To the fullest extent permitted by applicable law, Mocha Trips LLC is not responsible for losses, injuries, damages, delays, or disruptions resulting from circumstances outside its reasonable control or from the acts or omissions of independent third-party suppliers.

Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

CHARGEBACKS & PAYMENT DISPUTES

If you believe a charge associated with your reservation is incorrect, you are encouraged to contact reservations@mochafest.com promptly so that the issue can be reviewed and, where appropriate, resolved.

Initiating a chargeback does not automatically cancel the underlying reservation or eliminate amounts legitimately owed under these Terms & Conditions.

Mocha Trips LLC may provide booking records, payment authorizations, communications, acceptance of these Terms & Conditions, and other relevant documentation to payment processors or financial institutions when responding to a payment dispute.

FILMING & PHOTOGRAPHY

Photography, video recording, and other media production may occur during Mocha Fest events and Mocha Trips experiences.

By entering event areas, guests acknowledge that they may appear incidentally in photographs or recordings used for legitimate promotional, marketing, editorial, archival, or social media purposes.

FORCE MAJEURE

Mocha Trips LLC is not responsible for failure, delay, modification, or interruption of services caused by circumstances beyond its reasonable control.

Such circumstances may include severe weather, hurricanes, natural disasters, epidemics or public-health emergencies, war, terrorism, civil unrest, government actions or restrictions, strikes, transportation disruptions, utility failures, venue closures, or significant supplier disruptions.

Where such circumstances occur, Mocha Trips LLC may modify, postpone, relocate, substitute, or cancel affected portions of an event or travel experience as reasonably necessary.

Any refund or future credit available under such circumstances will depend on amounts recoverable from suppliers, contractual commitments, applicable policies, and applicable law.

PRIVACY & CUSTOMER INFORMATION

Mocha Trips LLC collects and uses personal information provided during the booking process to process reservations and payments, communicate with customers, provide customer support, administer events and travel arrangements, and operate its services.

If you begin but do not complete a booking, information already submitted during the booking process, such as your name and email address, may be retained and used to send reminders or communications relating to your incomplete booking.

Where permitted by applicable law, Mocha Trips LLC may also use contact information to send promotional communications, special offers, discounts, and information about upcoming Mocha Fest and Mocha Trips experiences.

Customers may unsubscribe from promotional email communications using the unsubscribe option included in those communications.

Payment information is processed through third-party payment processors. Payment credentials may be securely stored by those providers when necessary to facilitate authorized automatic installment payments.

Mocha Trips LLC does not sell customers’ personal information.

Personal information may be shared with service providers and suppliers where reasonably necessary to process payments, fulfill reservations, arrange travel services, communicate with customers, or otherwise provide purchased services.

ABANDONED BOOKINGS

If you provide your contact information but leave the booking process before completing payment, Mocha Trips LLC may retain information already submitted and contact you regarding the incomplete reservation.

These communications may include reminders or promotional incentives, including discount offers, intended to allow you to complete the booking.

Where required, customers will be provided with the ability to unsubscribe or opt out of promotional communications.

ELECTRONIC COMMUNICATIONS

By making a booking, you agree that booking confirmations, invoices, payment reminders, schedule updates, policy notices, and other communications relating to your reservation may be provided electronically using the contact information supplied with your booking.

You are responsible for providing accurate contact information and keeping it current.

TERMS ACCEPTANCE & RECORDS

By completing a booking and accepting these Terms & Conditions, you confirm that you have reviewed and agreed to the terms applicable to your purchase.

Mocha Trips LLC may maintain electronic records documenting acceptance of these Terms, including the date and time of acceptance and the version of the Terms accepted.

The Terms & Conditions applicable to a booking are generally those accepted when the booking was completed, except where changes are required by law or subsequently agreed to by the customer.

WEBSITE INFORMATION

Mocha Trips LLC makes reasonable efforts to ensure that pricing, schedules, descriptions, and other information published through its websites and booking platforms are accurate.

Occasional errors or omissions may occur. Where a material error is discovered, Mocha Trips LLC may correct the information and will make reasonable efforts to notify affected customers where necessary.

Mocha Trips LLC is not responsible for the content, availability, or privacy practices of independent third-party websites.
